LaptopTech respects the intellectual property rights of others, and we expect our visitors, contributors, and partners to do the same. This page explains how we handle claims of copyright infringement under the Digital Millennium Copyright Act of 1998 (“DMCA”), including how to report content you believe infringes your rights and how to respond if your content was removed by mistake.
1. Our Commitment to Copyright
Everything we publish on laptoptech.com, including laptop reviews, buying guides, comparisons, tutorials, and news, is intended to be original or properly licensed. We make an effort to credit sources, use images we have permission to use, and avoid copying other people’s work. We also understand that mistakes can happen. If you believe something on our site uses your copyrighted work without permission, we want to hear from you, and we will act quickly and in good faith.
2. What This Policy Covers
This policy applies to any content on laptoptech.com that may be protected by copyright, such as:
- Articles, text, and written reviews
- Photographs, product images, and screenshots
- Graphics, logos, charts, and infographics
- Videos, audio, and other media
- Comments or other material submitted by visitors
If you are not sure whether something you want to report counts as infringement, please contact us first. We are happy to talk it through.
3. Reporting Copyright Infringement (DMCA Takedown Notice)
If you are a copyright owner, or you are authorized to act on behalf of one, and you believe that material on laptoptech.com infringes your copyright, you may send us a written notice. To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- Your signature. A physical or electronic signature of the copyright owner or of a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work. A description of the work you claim has been infringed. If multiple works are covered by one notice, a representative list is acceptable.
- Identification of the infringing material. A description of the material you claim is infringing, along with enough information for us to find it, such as the exact URL of the page on laptoptech.com.
- Your contact information. Your name, mailing address, telephone number, and email address so we can reach you.
- A statement of good faith. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement of accuracy. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
Notices that are missing any of these elements may not be actionable, and we may ask you to provide the missing information before taking further steps.
4. Where to Send Your Notice
Please send DMCA notices to our designated copyright agent:
- Designated Agent: [Full name or title]
- Website: laptoptech.com
- Email: [dmca@laptoptech.com]
- Mailing address: [Street address, city, state or region, postal code, country]
Email is the fastest way to reach us. Please put “DMCA Notice” in the subject line so it reaches the right person without delay.
5. What Happens After We Receive a Notice
When we receive a complete and valid DMCA notice, we will generally take the following steps:
- Review the notice and the content it refers to
- Remove or disable access to the material that is claimed to be infringing
- Make a reasonable effort to notify the person who posted the material, if there is one, and provide them with a copy of the notice
- Keep a record of the notice and our response
We act on valid notices as quickly as we reasonably can, usually within a few business days. Removing or disabling access to material does not mean we agree that infringement occurred. It is a step we take to comply with the law while the matter is sorted out.
6. Counter-Notification
If you believe your content was removed or disabled because of a mistake or misidentification, or that you have the legal right to use the material, you may send us a counter-notification. A valid counter-notice must include:
- Your signature. A physical or electronic signature.
- Identification of the removed material. A description of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury. A statement that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your contact information. Your name, address, telephone number, and email address.
- Consent to jurisdiction. A statement that you consent to the jurisdiction of the federal court for the district where your address is located (or, if you are outside the United States, the district where laptoptech.com’s operator is located), and that you will accept service of process from the person who submitted the original notice or their agent.
Send your counter-notification to the designated agent listed above.
What happens next
When we receive a valid counter-notice, we will forward a copy to the person who filed the original complaint. Unless that person notifies us within 10 business days that they have filed a court action seeking to stop the alleged infringement, we may restore the removed material within 10 to 14 business days after receiving your counter-notice, at our discretion.
7. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have a policy of terminating, in appropriate circumstances, the access of users who are found to be repeat infringers. This may include blocking commenters or contributors who repeatedly post material that infringes the rights of others.
8. Warning About False Claims
Please be aware that making a false claim can have serious consequences. Under Section 512(f) of the DMCA, anyone who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be held liable for damages, including costs and attorneys’ fees. Before you send a notice or counter-notice, consider whether the use might qualify as fair use, and consider speaking with a qualified attorney if you are unsure of your rights.
9. Fair Use
Copyright law allows limited use of protected material without permission for purposes such as commentary, criticism, news reporting, teaching, and research. Because laptoptech.com publishes product reviews and tech commentary, we sometimes use short quotations, screenshots, or product images in ways that we believe are consistent with fair use. If you think we have gone beyond fair use, please tell us and give us the details. We will take your concern seriously.
10. Product Images, Specs, and Manufacturer Materials
Reviews and buying guides often include product photos, specification sheets, and press materials supplied by manufacturers, retailers, or affiliate partners. We use these materials with permission or under the terms the providers offer for media and affiliate use. All product names, logos, and brands mentioned on laptoptech.com belong to their respective owners. If you represent a brand and want a particular image or description changed or removed, please contact us and we will work with you.
11. User Comments and Submissions
If laptoptech.com allows comments or submissions, you are responsible for what you post. Please only share content that you wrote yourself or that you have permission to use. We do not claim ownership of your submissions, but by posting you give us a non-exclusive right to display them on the site. We reserve the right to remove any user content that appears to infringe copyright or otherwise violates our policies.
12. Links to Other Sites
Our site contains links to third-party websites, including retailers and manufacturers. We do not control those sites and are not responsible for their content or for any copyright infringement that may occur there. If you believe content on another website infringes your rights, you should contact that site’s owner or its hosting provider directly.
13. Our Own Content Is Protected Too
All original content on laptoptech.com, including our text, design, layout, and graphics, is protected by copyright and belongs to us unless stated otherwise. You may share short excerpts with a clear link back to the original article. You may not copy, republish, or redistribute our content in whole or in large part without written permission. If you find that someone has copied our work, we may send our own DMCA notice to the hosting provider or search engines involved.
14. Changes to This Policy
We may update this DMCA Policy from time to time. When we do, we will change the “Last updated” date at the top of this page. Please check back occasionally to stay informed about how we handle copyright concerns.
